The prosecution hasn’t put forward a single point that Chauvin had premeditated plans to kill Groyd (a necessary element of the 1st degree charge, right?) but they have tried a couple times to set up some kind of vague notion that he was purposefully maintaining his restraint tactic as some kind of... malicious retribution for non-compliance?

It’s silly. They haven’t met more than 25%(?) of potential factors to justify any of their charges. A giant, intoxicated dude was consistently resisting any command, they had to subdue him in the middle of a busy street upon his demand to lay on the ground and then an unruly crowd started to gather and threaten the officers... seems like a no brainer that you’d have to just hold the guy in place until EMS arrived.

I’m guessing acquittal, that is if the jury doesn’t get completely gaslit by the amassing mobs threatening violent riots. I bet the ‘demonstrations’ will really start to build around the courthouse next week and shit’s gonna get ugly.

There is no 1st degree charge. Charges are 3rd degree murder, 2nd degree murder claim and the 2nd degree manslaughter

  • The 2nd degree murder claim does not require intent to murder Groyd but still requires a murder committed in the course of another felony.
  • The 3rd degree murder charge requires a showing that Derek Chauvin "perpetrated an act eminently dangerous to others and evincing a depraved mind, without regard for human life."

I agree with your opinion on the jury and the riots

True, but they may well have made up their minds from the get-go. News articles say it may happen Monday after a couple of hours of deliberation — but of course it could go days longer. Time will tell...

"If he even hints that there are test results the jury has not heard about, it's going to be a mistrial, pure and simple. This late disclosure is not the way we should be operating here,"
Of course The (S)Hill lays out all the backstory and lead up... but then doesn’t print what happens when the witness walks in and almost immediately starts talking about the inadmissible test results that just ‘came to light’ earlier today.


He literally said if it was even hinted at, he would call this a mistrial... but, I guess not. 🤷🏼‍♂️
A very weird moment, an instant objection, a long side bar and then a couple breaks back to back.

Something happened, but maybe Nelson didn’t push for a mistrial now because he’s got more long term goals in mind, like future appeals...? Seemed like an intense slip-up that was wasted, maybe it will still amount to something eventually?

Yeah that was very dramatic for sure. I feel like Judge Cahill shouldn't have even allowed that rebuttal from Dr. Tobin and just had the evidence be over with, if he was worried about the state and Tobin's testimony, which proved to be true.

even though the judge was pretty fair overall, he seemed to rule in favor of the state more often than the defense.

he didn't sequester the jury or move the trial to another city, either at the beginning or after the Dante Wright episode, he didn't compel Morries Hall to testify, and he allowed many cumulative witnesses on behalf of the state. also letting the prosecution dump a bunch of evidence on the defense throughout the trial, even commenting " I don't think you're acting in bad faith". Well grow up mister judge they are obviously acting in bad faith throughout this mock trial.

I also found it interesting when Derek Chauvin officially invoked his Fifth Amendment privilege, and Mr. Nelson said that he and Chauvin went back and forth many different times over whether or not he should testify. I was wondering if he would or not. I think in an average case if this did not have the publicity, it's probably best not to subject your client to cross examination

But apart from intense cross-examination it could have potentially helped his case by humanizing him in the eyes of the jury since he has never had the chance to make any public statements about the incident, his life is pretty much forever changed (ruined) so it's kind of like what does he really have to lose.

Derek is also a pretty soft-spoken guy and not the stereotype people formed in their heads based on a still frame of a video, he could say that he didn't intend anything bad to happen, he did not put his knee on his neck for very long, that he had been trained to do that and was just following his training, that this has personally impacted him by his Asian wife leaving him, etc. his lawyer could even get him to apologize publicly on the stand. this really would have been his one and only chance to speak to the world about his side of the story, and could potentially sway a juror or two from treating him as harshly.

so I think that was the tension why they went back and forth, but I can understand the opposite as to why he decided not to because with that army of lawyers black Islam lawyers scheming in the corner they would love a chance to jump down his throat

Yes, just hearing him speak those brief little answers when he plead the 5th humanized him in my mind in a big way.

It really is too much of a gamble to open him up to cross, but maybe I’d recommend it anyway if I was just a little bit more confident in Nelson’s ability to bring out some undeniable humanity in him that could stand up to the prosecution’s tricks.

I guess I’m glad we’re moving on to the next phase, even though I wanted there to be a much more concerted effort by the defense to repaint both Groyd and the circumstances of the day in question to undo all that sappy fiction from the last couple weeks of court (and the last year of media spin.).

Sad I tapped out earlier during week 2 and missed this key moment from last night:

Chauvin Trial Day 14 - Irish Doctor Torpedoes Knee Choking Theory

For those of you not up to speed, this commentator on Channel Four News offers the following analysis and why this is so important: 98% blood oxygen is proof that GF died from coronary artery blockage stopping his heart rhythm (pulseless electrical activity). If GF had been asphyxiated by crushing and choking forces applied intermittently he would not have died so suddenly and thoroughly so quickly. If he was asphyxiated slowly (prosecution case) GF would not have been 5 minutes dead already by the time the EMTs had arrived because of resdiual oxygenation of his blood pumping around in a 'brain first' death scenario.

Nelson has basically proven using the state's own experts alone that GF died from his heart stopping and not from his lungs or neck being compressed. This means Chauvin is not responsible for any criminal charge because Chauvin was not able to save GFs life no matter what.

No matter what, once GFs heart stopped he was going to die that day on the pavement. Only the police use of force up to george floyd saying "I cant breathe ... im going down" (meaning to the ground before any pavement is involved) can be considered. This use of force is fully reasonable.

Finally the EMTs arriving late and having to load-and-go George Floyd is the only factor of negligence involved in this case. The state's best argument for manslaughter is applied to the EMTs for not being brave enough to treat immediately, and for not being dispatched to the scene effectively.
